This agreement is between Triple
H Equestrian Center, LLC. and
_______________________________(the horse owner).
Warning
Under Tennessee Law, an equine professional is not
liable for an injury to or the death of a participant in equine activities
resulting from the inherent risks of equine activities, pursuant to
Tennessee Code Annotated, title 44, chapter 20.
Definitions: The term, “OWNER,” shall herein refer to
the owner, part-owner, or lessee of the animal that is contracted to be
boarded under this Agreement. The terms, “HORSE” and “ANIMAL” shall herein
refer to all equine species, and also to specific animals to which this
agreement refers. The terms, “BOARD” and “BOARDING,” shall herein refer to
the provision for compensation of daily routine husbandry, food, and
physical space for animals by a party who does not generally have financial
interest in the animals. The term, “RIDER,” shall herein refer to a person
who rides a horse mounted or otherwise handles or comes near a horse from
the ground. The terms, “I”, “ME”, OR “MY,” shall herein refer to the owners
and the parents or legal guardians thereof if a minor.

II. Commencement of
boarding is contingent upon receipt by Triple H Equestrian Center, LLC.
of a deposit of one month’s boarding fees, and a
negative Coggins test.

IV. RIGHT TO REFUSE BOARD:
Triple H Equestrian Center, LLC. reserves the
right to refuse the continuation or board of any horse for any reason, to
include but not limited to: animals poor health or unsoundness; dangerous
propensities, habits, and/or vices that Triple H Equestrian Center, LLC.
is not equipped to handle; owners refusal to obey
stable rules or to cooperate with Triple H Equestrian Center, LLC.
on reasonable requests relative to the
management, welfare, and safety of animals and people on the premises; and,
also in the event of the discontinuation of the business of boarding horses.
Owner will be given a thirty days notice.
VI. Illness or Injury:
Triple H Equestrian Center, LLC. agrees to
attempt to contact the Owner by telephone in case of any emergency involving
the Owner’s horse. If Triple H Equestrian Center, LLC.
is unable to contact the Owner of the horse, Triple H Equestrian
Center, LLC. will attempt to communicate by
telephone with an emergency contact person to be provided by the Owner. If
Triple H Equestrian Center, LLC. is unable to
contact the Owner or the emergency contact person provided by the owner, at
Triple H Equestrian Center, LLC. discretion,
Triple H Equestrian Center, LLC. will contact a
veterinarian or farrier to protect the health of the Horse. The cost of such
emergency care will be paid by the owner. The agreement
of Triple H Equestrian Center, LLC. to
attempt to contact the owner, emergency contact person, veterinarian, and
farrier is limited to the numbers specified on the last page of this
agreement.
VII. OWNER ACCEPTANCE OF
RESPONSIBILITY: Owner has inspected Triple H Equestrian Center, LLC. and
satisfied himself/herself that the conditions of the premises and the
facilities will provide an adequate and reasonable level of safety for
Owner’s horse and Owner, Owners family, guest, and visitors who enter these
premises. Owner further agrees to be responsible for any and all damages,
injuries, loss of life caused by or to the animal while in the control of
the Owner, Owner’s family members, invitees or other handlers or agents
appointed by them, and also for any acts of the horse caused by vices or
dangerous behavior not disclosed to Triple H Equestrian Center, LLC.
by Owner. Owner is also responsible for
accidents, injuries and loss of life
VIII. RELEASE OF
LIABILITY: In consideration of Triple H Equestrian Center, LLC. and other
related services set forth herein, I, the undersigned Owner, do agree to
hold harmless and release Triple H Equestrian Center, LLC., Triple H
Equestrian Center, LLC., owners, agents, employees, directors,
representatives, assigns, members, premises owners, affiliated
organizations, and insurers, and others acting on Triple H Equestrian
Center, LLC. behalf (hereinafter collectively referred to as “Associates” of
all claims, demands, causes of action, and legal liability, whether the same
be known or unknown, anticipated or unanticipated, due to Triple H
Equestrian Center, LLC., gross negligence and willful and wanton misconduct,
I shall not bring any claims, demands, legal actions and causes of action,
against Triple H Equestrian Center, LLC. and Triple H Equestrian Center,
LLC. associates as stated above in this clause, for any economic and
non-economic losses due to bodily injury, death, property damage, and injury
to the animal(s), and/or sustained by me and/or my minor child or legal
ward, in relation to the premises and operations of Triple H Equestrian
Center, LLC.
